&'10 CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> G` NO. <br /> 7076 <br /> SH0 <br /> 1. This application was reviewed as Zoning File #LA19-000028. The analysis contained <br /> within staff memos and the exhibits attached to the aforesaid memos, all minutes from the <br /> above mentioned meetings, and any and all other materials distributed at these meetings <br /> are hereby incorporated by reference. <br /> 2. The Property is located in the LR-1C One Family Lakeshore Residential Zoning District. <br /> 3. The Property contains 0.18 acres in area and has a defined lot width of approximately 198 <br /> feet at the ordinary high water level. <br /> 4. The Property is platted as an outlot, and therefore is not buildable. <br /> 5. Applicant has applied for the following variance[s]: <br /> a. Back lot standards <br /> b. Double frontage lots, access to lots, and front/back lot divisions. <br /> 6. In considering this application for variance, the Council has considered the advice and <br /> recommendation of the Planning Commission and the effect of the proposed variance <br /> upon the health, safety and welfare of the community, existing and anticipated traffic <br /> conditions, light and air, danger of fire, risk to the public safety, and the effect on values <br /> of property in the surrounding area. <br /> ANALYSIS: <br /> 1. The variance is in harmony with the general intent and purpose of the Ordinance. The intent of <br /> the ordinance is the provision of a separate lot protecting access to a back lot while not <br /> introducing additional density. The access can be provided via an easement,and the nature of <br /> these lots do not lend themselves to further subdivision,i.e.density. <br /> 2. The variance is consistent with the comprehensive plan. The use of the property remains <br /> residential,consistent with the comprehensive plan. <br /> 3. The applicant establishes that there are practical difficulties. <br /> a. The property owner proposes to use the property in a reasonable manner not permitted <br /> by the official controls; The use of the property remains the same. <br /> b. There are circumstances unique to the property not created by the landowner; The <br /> condition of the property prior to development,configured as three separate lots,was <br /> not created by the developer. Further,the property is a peninsula and at the end of a <br /> dead end street. <br /> c. The variance will not alter the essential character of the locality. The variance,allowing <br /> access to the back lot via an easement versus an outlot will not be discernable to the <br /> character of the locality. <br /> 2 <br />
