Providing an escrow agreement and $6,000 escrow to guarantee improvement of the wetland buffer areas on Lot 2. 5. Execution of a Protective Covenant for Drainfield Sites. 6. Providing an escrow agreement and an escrow equal to 150%of the estimated cost or 1100/0 of the contracted cost to guarantee replacement of the septic system on Lot 2. I 7. Completion of any other platting requirements. i • I NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution No. 5771, the City Council of the City of Orono does hereby approve the plat of Majestic Spruce Addition, a copy of which is attached as Exhibit A, subject to the following .conditions: 1. The City Clerk shall release the plat documents for filing only upon certification by the City ! Attorney, City Planner and City Engineer that all requirements of the platting regulations , have been satisfied and that the Minnehaha Creek Watershed District has granted conditional approval of any required permit(s). 2. The aforesaid plat shall be filed with Hennepin County on or before April 20,2009 together ! with a certified original copy of this resolution and executed copies of the easement and covenants pertinent thereto. The approval granted by this Resolution shall expire if the conditions of this Resolution have not been met or the plat has not been filed by the date specified above. In that event,it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City Council of Orono this 27th day of October,2008. Page 2 of 3
