(reserved for recording information) <br /> RESTRICTIVE COVENANT <br /> FOR <br /> PROTECTION OF SEWAGE TREATMENT SITES <br /> KNOW ALL MEN BY THESE PRESENTS that WOLVERTON PLACE,LLC,a <br /> Minnesota limited liability company ("Owner"), does hereby expressly covenant and agree to <br /> protect the approved sewage treatment sites on the real property in Hennepin County, Minnesota, <br /> legally described as Lot 1, Block 1,FOXFYRE ESTATES (the "Property"), as follows: <br /> Each lot within the Property has two Orono-approved sewage treatment sites, depicted on <br /> the survey attached hereto as Exhibit"A". To protect these important sites from <br /> inadvertent damage or destruction, no owner shall permit any cars, trucks, or earth <br /> moving equipment to enter upon the lot of any other owners. Additionally, no lot owner <br /> shall construct any driveway, erect any building, or permit any earth moving equipment <br /> on that owner's lot without first: <br /> 1. Erecting a clearly visible fence during construction twenty feet from the boundary <br /> of its sewage treatment sites along that part of the site that is between the site and <br /> all areas which are accessible to earth moving equipment; and <br /> 2. Erecting a clearly visible fence during construction along that part of the owner's <br /> lot line that is between an adjacent owner's sewage treatment site and the areas on <br /> the owner's lot which are accessible to earth moving equipment. <br /> This Restrictive Covenant shall run with the land, shall be binding upon the Owner, its <br /> respective heirs, successors and assigns, and may be terminated only upon written agreement of <br /> the City of Orono. <br /> The above named Owner, its successors and assigns, does covenant with the City, its <br /> successors and assigns,that it is well seized in fee title of the above described Property; that it has <br /> 169692 1 <br />
