Property Defects <br /> 77. WPLLC, Stephenson, Gherardi, Berg, and Coldwell held out the Property <br /> to the Plaintiffs as being in "excellent" condition. <br /> 78. At some point in the spring or summer of 2012, WPLLC, Stephenson, <br /> Gherardi, and Coldwell had knowledge of flooding damage in the basement of the <br /> Property. <br /> 79. As a result of the flooding damage to, and wet condition of, the basement, <br /> at least one showing of the Property was altered. <br /> 80. After moving into the Property, the Plaintiffs discovered extensive defects, <br /> including landscaping that was defective, including having improper grading, and did not <br /> comply with code; defective HVAC equipment; defective kitchen appliance installation; <br /> and evidence of extensive and repeated water intrusion resulting in severe damage to the <br /> Property, and in particular to the basement and garage. <br /> 81. The defects to the Property were concealed using a variety of cosmetic <br /> fixes that did not address the underlying damage and appear to have been implemented <br /> solely to conceal the existence of water damage from prospective buyers. <br /> 82. The underlying susceptibility of the Property to the flooding was not <br /> addressed prior to the sale, and additional flooding has occurred virtually every time it <br /> has rained on the Property. <br /> 83. The defects in the Property appear to result from faulty workmanship, <br /> faulty installation, defective materials, and noncompliance with building standards. <br /> 14 <br />
