CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ye G NO. 7070 <br /> ,-'kES HO <br /> A RESOLUTION <br /> APPROVING A CONDITIONAL USE PERMIT <br /> PURSUANT TO MUNICIPAL ZONING CODE <br /> SECTIONS 78-644 & 78-916 <br /> FILE NO.LA19-000098 <br /> WHEREAS, on November 24, 2019, Joe Hahs, owner of Evergreen Construction, <br /> (herein after the "Applicant"), applied for a conditional use permit pursuant to the City Code for the <br /> property addressed 2385 Shadywood Road and legally described as: <br /> That part of Lot 5, Block 3, Townsite Of Langdon Park described as beginning at a <br /> point on the West line of said Lot 5 distant 105.5 feet North from the Southwest corner of said <br /> Lot 5; thence North along said West line a distance of 77.20 feet; thence North 74 degrees <br /> 24 minutes East(assuming said West line as bearing North) a distance 202.4 feet, more or <br /> less,to the Southwesterly right-of-way line of County Road Number 19;thence Southeasterly <br /> along said Southwesterly right-of-way line, a distance of 75 feet more or less to an <br /> intersection with a line bearing North 74 degrees 24 minutes East from the point of beginning; <br /> thence South 74 degrees 24 minutes West a distance of 230.63 feet, more or less, to the <br /> point of beginning, except that part thereof embraced within the South 149.5 feet of the West <br /> 119.5 feet of said Lot 5, and except that part of said Lot 5 lying North of the South 149.5 feet <br /> of said Lot 5 and Westerly of a line bearing North 21 degrees 31 minutes West drawn from <br /> the Northeast corner of the South 149.5 feet of the West 119.5 feet of said Lot 5, Hennepin <br /> County, Minnesota (hereinafter the"Property"); <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> conditional use permit ("CUP") pursuant to Orono Municipal Zoning Code Sections 78-644 and <br /> 78-916 in order to allow an office use of the Property; and <br /> WHEREAS, on January 21, 2020, after published and mailed notice in accordance <br /> with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br /> which time all persons desiring to be heard concerning this application were given the opportunity <br /> to speak thereon; and <br /> WHEREAS, on January 21, 2020, the Planning Commission recommended <br /> approval of the CUP for office use; and <br /> WHEREAS, on February 10, 2020, the City Council reviewed the application and <br /> the recommendations of the Planning Commission and City staff; and <br /> 1 <br />
