The portions of dedicated easements to be vacated no longer have a public benefit <br /> • because the public drainage and utility purposes no longer exist; the approved <br /> topographic changes within the railroad corridor have resulted in the obliteration, <br /> removal or relocation of all pre-existing drainageways, wetlands, utility lines, etc. in the <br /> area of the easements to be vacated. <br /> 2. The vacation of said easements will not eliminate access to any adjoining or nearby <br /> properties. <br /> 3. Utility companies have been notified of the proposed vacations and none have indicated <br /> opposition to the vacations. <br /> 4. The City does not intend to use the easements to be vacated for any future public <br /> purpose. <br /> NOW, THEREFORE, BE IT RESOLVED, that the petition of MnDOT is <br /> hereby granted by the Council of the City of Orono and that the portions of easements as legally <br /> described and depicted in Exhibits A and B attached hereto, are hereby vacated. <br /> Adopted by the City Council of the City of Orono, Minnesota at a regular meeting <br /> held on April 9, 2007. <br /> • <br /> ATTEST: <br /> C . <br /> Linda S.
