The Planning Commission made the following findings of fact: <br /> A. Fill will be brought from construction of the road for "Wildhurst Woods", an <br /> adjacent subdivision. No fill will be brought from off site. <br /> B. The fill and grading will not impact drainage onto the"Wildhurst Woods"site or <br /> existing drainage patterns. <br /> C. The proposed construction will not interfere with on-site septic systems. <br /> 5. The City Council finds that granting a conditional us permit will not be detrimental <br /> to the health,safety or general welfare of the public,would not adversely affect light, <br /> air nor pose a fire hazard or other danger to neighboring properties, nor will its use <br /> depreciate surrounding property values and that the proposed level of use of the <br /> property will be in keeping with the intent and objectives of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> 6. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City Staff, comments by <br /> the applicant and the effect of the proposed conditional use permit on the health, <br /> safety and welfare of the community. <br /> CONCLUSIONS, ORDER, AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br /> conditional use permit per Municipal Zoning Code Section 10.03, Subdivision 19 to permit <br /> in excess of 500 cubic yards of fill to be brought onto subject property for the purpose of <br /> constructing golf tees and greens. Approval is subject to the following conditions: <br /> 1. Council approval is based on the site plan submitted by the applicant attached to this <br /> resolution as Exhibit A. Any amendments to the site plan may require further <br /> Planning Commission and City Council review. <br /> 2. Silt fence shall be in place prior to fill or grading activities.
