Box 66 <br /> Crystal Bay, MN 55323 <br /> Re: Lot 4, Block 1, Wildhurst Estates - Sewer Easement <br /> Our File No. 752031 <br /> Dear Mike: <br /> As you requested, I reviewed the record title of the above-referenced property at the <br /> office of the Hennepin County Registrar of Titles to determine whether there is an easement of <br /> record for the sewer line that crosses through Lot 4, Block 1, Wildhurst Estates (the <br /> "Property"). I found that the title to the Property is registered as evidenced by Certificates of <br /> Title Nos. 1014256 and 1014257, copies of which are enclosed. The fee owners of the Property <br /> are R& I Construction of Bloomington, Inc., a Minnesota corporation, as to an undivided 50% <br /> and Cheryl Wetherbe and James Wetherbe, as joint tenants, as to an undivided 50%. <br /> The certificates disclose that the only easement of record in favor of the City of Orono <br /> against the Property, other than the platted drainage and drainage and utility easements, is a <br /> Flowage and Conservation Easement and Waiver of Damages recorded December 9, 1991, as <br /> Document No. 2221015. A copy of this easement is enclosed for your reference. Any easements <br /> effectively recorded against the Property would have to be shown on the Certificates of Title <br /> because the property has been registered since 1946. In the event you determine that the City <br /> would have had its easement prior to 1946, please let me know and I will examine the prior title <br /> and the registration file, if necessary, to insure that the City received proper notice of the title <br /> registration. <br />
