Christine Mattson <br /> From: Christine Mattson <br /> Sent: Wednesday, February 26, 2014 8:51 AM <br /> To: 'kelly©sellitwithdayna.com' <br /> Subject: 1003 Wildhurst Trail <br /> Attachments: zoning app 2293.pdf <br /> Kelly, <br /> The Morgat properties addressed as 1003 Wildhurst Trail are complex. <br /> I have attached a copy of zoning application#2293 and minutes from 1997 where a developer had requested <br /> rezoning/comprehensive plan amendment/subdivision/vacation. <br /> Please be aware that the westerly 10-acre parcel is zoned for 2-acre minimum lot size and is not in the MUSA, hence <br /> cannot be provided with municipal sewer. The properties east of the 10-acre parcel are zoned for 1-acre lots and are <br /> within the MUSA and therefore can be served with municipal sewer. <br /> As Hennepin County's website shows,there are platted dedicated rights-of-way separating the various components of <br /> the Morgart property. Whether the City would vacate the rights-of-way will not be determined until a proposal for <br /> development appears before the City. If it is determined that some combination of the rights-of-way provides potential <br /> public access to Lake Minnetonka, a vacation is unlikely. Vacation of certain elements of the right-of-way not related to <br /> lake access might be feasible. <br /> All existing Joint Use Dock lots in Orono were created several decades ago. According to an excerpt from City Code <br /> Section 78-1330(3)within the RPD/PUD Standards...The number of dwelling units or sites which maybe granted lake <br /> access shall not exceed the number of riparian dwelling units or sites which could be created under a standard <br /> subdivision. In this case the zoning district is 1 acre requiring 140' in width. The land that directly abuts the ordinary <br /> high water level (OHWL is approximately 305 feet. Only the two lots that directly abut the lake would be allowed a <br /> dock, none of the other lots would qualify.
