the City may use the Letter of Credit to complete the Public Improvements required under this <br /> Agreement at Developer's expense. If a building permit is submitted as required above, the <br /> Commercial Site Plan Approval shall not lapse for any of the other Lots, except as provided in <br /> Section 5 herein. <br /> 5. CHANGES IN OFFICIAL CONTROLS. For five (5) years from the date of <br /> this Agreement, no amendments to the City's Comprehensive Plan or official controls shall apply <br /> to or affect the use, development density, lot size, lot layout or dedications of the approved Plat <br /> or each Commercial Site Plan unless required by state or federal law or agreed to in writing by <br /> the City and the Developer or its assigns. Thereafter, notwithstanding anything in this <br /> Agreement to the contrary, to the full extent permitted by state law, the City may require <br /> compliance with any amendments to the City's Comprehensive Plan, official controls, platting or <br /> dedication requirements enacted after the date of this Agreement. <br /> 6. CONDITION FOR SUBSEQUENT APPROVALS. The entire Development <br /> has received Commercial Site Plan Approval. Therefore, additional City review prior to <br /> construction of future buildings or renovation of the existing building on Lot 3, Block 2, will be <br /> limited to Building Permit Approval by City Staff. All structures shall be built consistent with <br /> the Commercial Site Plan Approval. <br /> 7. IMPROVEMENTS. <br /> A. PUBLIC IMPROVEMENTS: The Developer shall install and pay for <br /> the following Public Improvements: <br /> 1. Streets: <br /> a. Orono Industrial Boulevard <br /> b.
