3. City, its contractors, agents, and servants may enter upon the easement areas at all <br /> reasonable times to construct, reconstruct, inspect, repair, and maintain said water main or line <br /> across, on, under, and through the Easement Property. <br /> 4. City agrees to indemnify and hold Landowner harmless from claims or damages, <br /> including reasonable attorneys fees, resulting directly and solely from the use of the easements. <br /> This indemnification, however, shall not include, and City shall not be responsible for, costs, <br /> expenses, damages, demands, obligations, including penalties and reasonable attorney's fees, and <br /> losses resulting from any claims, actions, suits, or proceedings based upon a release or threat of <br /> release of any hazardous substances, pollutants, or contaminants which may have existed on, or <br /> which related to,the property prior to the date hereof and which were not caused by City. <br /> 5. Landowner represents that it is well seized in fee of the lands and premises <br /> aforesaid and has good right to grant and convey the easement herein. <br /> 6.
