Box 66 <br /> Crystal Bay, MN 55323 <br /> RE: Request for Information Pertaining to Installation of Docks on Stubbs Bay <br /> Dear Mr. Gaffron: <br /> Thank you very much for our phone conversation yesterday in regard to some questions <br /> that I had pertaining to the installation of docks on Stubbs Bay of Lake Minnetonka. <br /> Our office represents Mr. and Mrs. Jay Jasper of Waconia, who are the owners of Lots <br /> 10, 11 and 12, Block 1, Hillside Park, in Orono. A copy of the Certificate of Title for this <br /> property is enclosed for your information. <br /> This property is for sale and there is a prospective purchaser. However, the purchaser <br /> does not wish to purchase the property unless the "blanket" right-of-way that presently exists <br /> across this property as shown on the Certificate of Title can be removed. It is my <br /> understanding that the owner of this existing right-of-way is not willing to simply relinquish his <br /> interest. However, it is my understanding that he would consider the relinquishment of the <br /> interest if, in exchange, he could have the right to install a dock off of the southwest corner of <br /> Lot 12 of Block 1, with a very limited restriction of access to the dock over this property. <br /> It is my understanding the proposed purchaser of this property would remove the <br /> existing buildings and construct a completely new dwelling. Obviously, it would be of help to <br /> all parties if this blanket right-of-way could be released and redevelopment of this property <br /> could occur. <br /> Therefore, we would like to investigate the possibility of obtaining permission from the <br /> City of Orono to grant the right to allow an additional dock to be installed in approximately the <br /> location indicated, which right would be made legally appurtenant to the owner of Lot 3, Block <br /> 2, of Hillside Park,through an easement or other type of document.
