o : � o <br /> fi CITY of ORONO <br /> 6c' RESOLUTION OF THE CITY COUNCIL <br /> `9kES 4" NO. 5 2 z <br /> A RESOLUTION GRANTING VARIANCES <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-305 (B) <br /> FILE NO. 04-3051 <br /> WHEREAS, Kevin A. Fitzpatrick and Julie Fitzpatrick, husband and wife <br /> (hereinafter "the applicants") are the owners of the property located at 356 Westlake <br /> Street within the City of Orono (hereinafter the "City") and legally described as follows: <br /> Lot 8, Block 1, Hillside Park, Hennepin County, Minnesota <br /> (hereinafter the "property"); and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for variances to Orono Municipal Zoning Code Section 78-305 (B) to allow construction <br /> of a new residence on a lot that is 0.643 acres in size when 2.0 acres is normally required, <br /> is 50.50 feet in width at the shoreline and 75' setback when 200' is normally required, <br /> and north and south side yard setback requests to allow 10' side yard setbacks when 30' <br /> is normally required. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono, Mimiesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#04-3051. <br /> 2. The property is located in the LR — 1A zoning district, which requires a <br /> minimum lot area of 2.0 acres. The applicants' property is 0.643 acres in <br /> area. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on September 20, 2004 and recommended approval of the variances <br /> based on the following findings: <br /> a.
