City of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> s� <br /> N . 2924 <br /> A RESOLUTION GRANTING <br /> AFTER-THE-FACT VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 10.22, SUBDIVISIONS 1 & 2 AND <br /> SECTION 10.55, SUBDIVISION 8 <br /> FILE #1611 <br /> WHEREAS, Bruce and Camille Curtiss (hereinafter "the <br /> applicants") are the owners of the property located at 1920 <br /> Fagerness Point Road within the City of Orono (hereinafter <br /> "City") and legally described as follows: <br /> Exhibit A, attached (hereinafter "the property"); and <br /> WHEREAS, the applicants have applied to the City for <br /> after-the-fact variances to Municipal Zoning Code Section 10.22, <br /> Subdivisions 1 and 2 and Section 10.55 , Subdivision 8 to permit <br /> the construction of an upper level deck constituting structure <br /> and hardcover in the 0-75' lakeshore setback zone where no <br /> structure or hardcover is normally allowed. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1 . This application was reviewed as Zoning File #1611. <br /> 2. The property is located in the LR-lC Single Family <br /> Lakeshore Residential Zoning District. <br /> 3. The Orono Planning Commission reviewed this application <br /> on January 22 , 1991 , and recommended approval of the <br /> proposed after-the-fact variances based upon the following <br /> findings: <br /> A) The newly constructed deck is in approximately the <br /> same configuration and same location as a previously <br /> existing deck which was removed immediately prior to <br /> this new construction, being located 25' from the <br /> shoreline. Based on documentation appearing in City <br /> files, it appears likely that the new deck has not <br /> increased hardcover on the property beyond that which <br /> previously existed, and the new deck is located no <br /> closer to the lakeshore than the previously existing <br /> deck. <br /> Page 1 of 5 <br />
