The Orono Planning Commission reviewed the application on August 19, 1996, <br /> and on a vote of 5-1 recommended approval of the proposed variances based <br /> upon the following findings: <br /> A. Applicant has removed significant amounts of excessive hardcover in the <br /> 0-75' zone in conjunction with previous variance approvals on the <br /> property. There is no remaining hardcover in the 0-75' zone which could <br /> be easily removed. <br /> B. Hardcover in the 0-75' zone will not change as a result of the proposed <br /> roof pitch revisions. <br /> C. Hardcover in 75-250' zone will be reduced from 31.0% to 30.25%, a <br /> reduction of 217 s.f. of hardcover. Reduction in hardcover will be <br /> accomplished by removal of an island within the center of the large <br /> driveway area, making that driveway appear as a loop rather than as a <br /> cul-de-sac. The proposed reduction is adequate given the size and <br /> configuration of the property. <br /> D. The average lakeshore setback variance is justified by the conclusion that <br /> existing views of the lake enjoyed by neighboring property owners will <br /> not be encroached upon by the proposed additions or roof revisions. <br /> E. Lot coverage on the property is currently 7.7% and with the proposed <br /> additions will increase to 8.8%, meeting the standard 15% limitation. <br /> F. Although the lot size is conforming with an area of approximately 1.5 <br /> acres, nearly half of the lot is in the 0-75' setback zone, resulting in <br /> overall hardcover on the property just under 19%, meeting the DNR <br /> maximum hardcover standard of 25% of the property area. <br /> G. The shape of the lot and the curve of the shoreline, as well as the fact <br /> that lake exists on both the north and east sides of the property are <br /> hardships that are unique to the property. <br /> Page 2 of 5 <br />
