1O`V <br /> O <br /> ==^A , CITY of ORONO <br /> 1 ,��ryl�, RESOLUTION OF THE CITY COUNCIL <br /> '1 .411V4 �+ <br /> ikEsKo4 NO. 5 9 5 <br /> A RESOLUTION VACATING <br /> PART OF A DRAINAGE AND UTILITY EASEMENT <br /> FILE NO. 10-3474 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS,James W. Pierpont and Judith A. Pierpont(husband and wife), the <br /> owners of Lot 15, Block 1, THE FARM AT LONG LAKE Hennepin County, Minnesota, <br /> (commonly known as 1801 West Farm Road in the City of Orono),have petitioned for vacation of <br /> part of a drainage and utility easement within said Lot 15; and <br /> WHEREAS,after mailed,published,and posted notice,a public hearing was held by <br /> the Orono Planning Commission on June 21,2010,regarding said vacation and all interested persons <br /> were given an opportunity to be heard; and <br /> • <br /> WHEREAS, immediately following this public hearing the Orono Planning <br /> Commission recommended approval of the vacation by a vote of 5 - 0; and <br /> WHEREAS,in consideration of the following findings the Orono Council finds the <br /> vacation as proposed is in keeping with the public interest: <br /> 1. James W. and Judith A. Pierpont are the owners of all property underlying the <br /> portion of the drainage and utility easement proposed to be vacated. <br /> 2. The gas, electric, telephone and cable companies have consented to the vacation. <br /> 3. The City Engineer finds the vacation acceptable. <br /> 4. The vacation will eliminate the encroachment of two buildings on the easement. <br /> These buildings existed long before the easement was dedicated in the plat of The <br /> Farm at Long Lake. <br /> Page 1 of 2 <br />
