MEMORANDUM <br /> DATE: 2 July 2010 <br /> TO: Lyle Oman, Building Official <br /> Willie Gibbs, Building Inspector <br /> CC: Jessica Loftus, City Administrator <br /> FROM: Melanie Curtis, Planning&Zoning Coordinator <br /> RE: Temporary Certificate of Occupancy <br /> In the absence of a zoning compliance/certificate of approval requirement,we have always <br /> provided a place for planning staff approval on the certificate of occupancy. This planning staff <br /> signature assures compliance with the hardcover, setbacks,grading and site plan. Historically, <br /> we have issued temporary certificates of occupancy in situations where necessary corrections <br /> were simple, not life safety issues, or where winter conditions do not allow for finalization of the <br /> exterior improvements, grading etc. Temporary COs have become something of a convenience <br /> for builders and home owners who have pending closing dates or wish to move in to a nearly <br /> completed home. However by their very nature, issuance of a temporary CO allows a property <br /> owner to move into and occupy the home before all requirements have been met. <br /> On occasion,this fact has made it difficult to require a homeowner to come into full compliance <br /> with the approved plans. Staff should use temporary COs with caution, as our ability to compel <br /> a property owner to comply is not as strong once they occupy the home. <br /> As of today,the form for temporary certificates of occupancy shall include a signature line for <br /> planning staff approval. I would like to have a meeting to discuss whether or not we need to <br /> develop a zoning compliance CO or if we are able to accomplish our goals with a cooperative <br /> effort. <br />
