To: Chair Thiesse and Planning Commission Members <br />Dustin Rief, City Administrator <br />From: Melanie Curtis, Planner mcc <br />Date: 17 September 2018 <br />Subject: #LA18-000057, Text Amendment: Accessory Building & Structure Setbacks <br />Memo #4 - Public Hearing - Continued <br />Application Summary: The draft ordinance would re -organize the regulations, and clarify the <br />setbacks for accessory buildings and structures throughout the City. <br />Staff Recommendation: Planning Commission should continue the public hearing opened in <br />June and discuss the proposed format and amendments. Staff will prepare an ordinance for <br />future consideration, based on input received. <br />Background/Update <br />This is a continuation of the discussion beginning in June, regarding proposed changes for <br />Accessory Building and Structure setbacks. The changes discussed thus far have been regarding <br />the overall organization of the regulations in the Code, and whether or not adjustments to the <br />existing setbacks are needed. <br />For the August meeting, Staff prepared a summary of the existing regulations in a newly <br />organized table format, as well as a table showing proposed changes to the setbacks for the R - <br />1A, R1 -B, LR -1A, & LR -1B districts. The proposed changes to the setbacks shown reflected the <br />feedback from the previous discussions with the Planning Commission. Staff took the feedback <br />given at the August meeting and continued to develop the remainder of the residential tables <br />continuing the same agreed-upon philosophy. The RS District (i.e. Big Island and Deering Island) <br />has some additional complications and staff is seeking guidance on how to proceed regarding <br />accessory building/structure setbacks in that district. <br />For clarification: <br />AS = Accessory Structure, anything which is built, constructed, erected, etc... <br />AB = Accessory Building (a structure with a roof) less than 1000 square feet <br />OAB = Oversized Accessory Building a structure with a roof exceeding 1000 square feet <br />Planning Commission should review the additional tables and the setbacks contemplated within; <br />some are new and some are a clarification on the existing. Additionally staff asks that the <br />Planning Commission provide direction on the following questions/topics: <br />RS Seasonal Recreational District - Big Island/Deering Island. The current minimum side <br />yard setbacks for all structures and buildings are based on the width of the property. For <br />example: Lots 200 feet or more in width have a minimum side setback requirement of <br />50 feet. Lots greater than 100 and less than 200 feet in width have a minimum side <br />setback requirement of 30 feet. And lots less than 100 feet in width have a minimum 10 <br />foot side setback. This can also be accomplished similarly to our recent setback <br />flexibility for lots with nonconforming widths where we permit the side setback to be <br />10% of the lot width but not less than an appropriate minimum (10 or 7.5 feet, etc.). <br />
