The noise <br />resulting from the trucks hauling and equipment moving the material in and <br />around the site should be minimized to the extent possible. The grading project <br />will be monitored by the City Engineer and planning staff so as to minimize <br />nuisances during the project. <br />A CUP may be granted subject to such conditions as the Council may prescribe. Additionally, <br />a CUP shall remain in effect as long as the conditions imposed by the City Council are <br />observed, but nothing in this section shall prevent the city from enacting or amending official <br />controls to change the status of conditional uses. <br />Practical Difficulties Statement <br />Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br />Conditional Use Permit Analysis <br />Staff finds the requirements for a land alterations conditional use permit are met. The owner <br />needed to correct existing poor soils on the site. This created the need for excess fill. The <br />applicant is working to create a walkout lot for the property which is cohesive with the <br />neighborhood. A new engineered grade was created as well for the property allowing the <br />proposed home to meet the height requirements per City Code. The applicant was able to use <br />some of the removed soil to fill in various areas to create a new walk out style lot limited the <br />amount of hauling needed for the project. The applicant has received a Minnehaha Creek <br />Watershed Permit for the proposed new home. <br />Public Comments <br />To date, no public comments have been received. <br />Issues for Consideration <br />1.
