The granting of such variance will not merely serve as a convenience to the applicant, but <br />is necessary to alleviate demonstrable difficulty. The application has stated the shallow <br />lot has setback challenges for construction of a single family home. The property is <br />unique in size for this zoning district. The Commission should discuss whether the <br />additional 18 feet of structure is necessary or a convenience. <br />The Commission may recommend or Council may impose conditions in granting of variances. <br />Any conditions imposed must be directly related to and must bear a rough proportionality to the <br />impact created by the variance. No variance shall be granted or changed beyond the use <br />permitted in this chapter in the district where such land is located. <br />Practical Difficulties Statement <br />Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br />Practical Difficulties Analysis <br />Staff finds is inherent practical difficulties with the small lot on the LR -1A, 2 acre zone. The <br />applicant has made an effort to meet the district standards for a new home and is requesting the <br />rear yard setback, lot area and lot width variances. The Commission should discuss whether the <br />rear yard setback encourages development out of character with the neighborhood. <br />Engineer Comments <br />A full review will be done at the time of building permit application. <br />1. The applicant will need to ensure that none of the hardcover runoff is directed toward <br />the neighboring lots. <br />2. The applicant will need to apply for a utility permit concurrent with any demo permit to <br />ensure the sanitary sewer service is properly disconnected. <br />Public Comments <br />To date, no public comments have been received. <br />Issues for Consideration <br />1. Does the Planning Commission find that the variance(s), if granted, will not alter the <br />essential character of the neighborhood? <br />2. The Commission should review discuss the proposed house as it fits into the <br />character of the neighborhood. <br />3. The applicant is not requesting a height variance at this time. The commission should <br />confirm the home will not exceed the 30 foot maximum height requirement. <br />4.
