Date Application Received: 6.20.2018 <br />Date Application Considered as Complete: 6.22.18 <br />60 -Day Review Period Expires: 8.21.2018 <br />To: Chair Thiesse and Planning Commission Members <br />Dustin Rief, City Administrator <br />From: Laura Oakden, Planner <br />Date: July 16, 2018 <br />Subject: LA18-000063, Matt Johnson, 1432 Shoreline Drive, Variance, Public Hearing <br />Application Summary: The applicant is requesting variance in the 75 foot lakeyard setback and <br />the average lakeshore setback for a 6' tall privacy fence. <br />Staff Recommendation: The Planning Commission should discuss of the proposed request is <br />in harmony with the intent of the ordinance and review of the proposed findings and if they <br />are supported by the commission staff recommends approval of the variance. <br />Background <br />The applicant is requesting to construct a 6 foot tall white privacy fence along the south <br />property line which abuts a neighboring property. <br />The 75 foot lake yard setback impacts the subject property from both the west (Tanager Lake) <br />and the east side (Browns Bay). The lot is substandard to size for the LR -1A, 2 acre, District. The <br />applicant is looking to create additional separation between the neighbor to the south which <br />uses the property as a commercial parking lot as well as a home. A fence would mitigate sound <br />and visibility between the two properties. The applicant has stated there is an existing fence <br />post located in the lake yard they would like to connect the new fence to the existing post. The <br />fence will connect to a fence along the east property line; this fence, though with the 75 lake <br />yard from Browns Bay, replaces a preexisting fence, no variance was required. The applicant <br />has submitted a narrative with pictures for you to review. <br />LOT ANALYSIS WORKSHEET <br />Section 78-305- Setbacks: <br />DISTRICT LR -1A Required <br />Proposed <br />Lakeshore 75' <br />1 15' <br />Average Lakeshore The fence is proposed to be 6 feet, 42 inched is permitted in <br />places. <br />Applicable Regulations: <br />Nonencroachments (78-1405)8b <br />2. Fences within the required side yard of a lakeshore lot shall not exceed six feet in <br />height, and shall not exceed 42 inches in height for any portion located lakeward of a <br />line drawn between the most lakeward projection of the fence owner's principal <br />residence structure and the most lakeward projection of the principal residence <br />structure on the adjacent property abutting the side yard in which the fence is located. <br />
