In the absence of rezoning, the approved master development plan and final site and <br />building plan shall remain the legal control governing development of the property included within the <br />RPUD. <br />(Ord. No. 202 2nd series, § 1(7), 2-26-2001) <br />Sec. 78-629. - Amendments. <br />Major amendments to an approved master development plan may be approved by the city council <br />after review by the planning commission. The notification and public hearing procedure for such <br />amendment shall be the same as for approval of the original RPUD. A major amendment is any <br />amendment which: <br />(1) Substantially alters the location of buildings, parking areas or roads; <br />(2) Increases or decreases the number of residential dwelling units; <br />(3) Increases the gross floor area of any individual building; <br />(4) Increases the number of stories of any building; <br />(5) Decreases the amount of open space or alters it in such a way as to change its original design <br />or intended use; or <br />(6) Creates noncompliance with any special condition attached to the approval of the master <br />development plan. <br />Any other amendment may be made through review and approval by a simple majority vote of the <br />council. <br />(Ord.
