' r <br /> kEI3 <br /> CONCLUSIONS, ORDER, AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> approves an extension of the effective period of Resolutions No. 4585, 4993, 5059 and 5084 to <br /> December 31,2005;and hereby approves an amendment to the hadustiial Site Plan Approval granted <br /> via Resolution No. 4845 to allow revisions to the easterly parking lot lighting plan to increase from <br /> four 25-foot poles each with double-1000 Watt downcast shoe-box style fixtures, to twelve such <br /> poles, subject to the following conditions: <br /> 1. The berm and plantings for parking lot screening as required by Resolution No. 4845 along <br /> the northerly and northeasterly perimeters of the easterly parking lot shall be installed no later <br /> than June 30, 2005. <br /> 2. The conditions of Resolutions No. 4845, 4993, 5059 and 5084 shall remain in effect except <br /> as modified by this Resolution. <br /> 3. The lighting plan is approved per the site and lighting plans attached hereto as Exhibit B,and <br /> any further revisions to these plans may require fiirther City review and approval. <br /> 4. The applicant is advised that the lighting plan herein approved is considered by the City to be <br /> the maximum extent of lighting that will be approved for the easterly parking lot. <br /> 5. Authorities granted by the conditional use permit run with the property not with the <br /> applicant. <br /> 6. Violation of or non-compliance with any of the ten-ns and conditions of the conditional use <br /> pennit approval shall constitute a violation of the zoning code, shall automatically tenninate <br /> any authority granted herein, and shall be punishable as a misdemeanor. <br /> 7. The undersigned applicant and property owner has read, understands and hereby agrees to <br /> the terms of this resolution and on behalf of himself,his heirs,successors and assigns,hereby <br /> agrees to the recording of this resolution in the Chain of Title of the property. <br /> Page 3 of 6 <br />
