City of ORONO <br /> _ RESOLUTION OF THE CITY COUNCIL <br /> NO. 2042 <br /> 4. The Orono Planning Commission reviewed this application on <br /> July 21, 1986 and August 18, 1986., and recommended approval of <br /> the proposed variances and ' conditional use permit for the <br /> accessory structure within Orono's Industrial District based on <br /> the following findings: <br /> A) To approve a variance to Section 2, Ordinance 13, Second <br /> Series: <br /> 1. The non-controversial nature and minimal scope of <br /> this application does not find the use in conflict with <br /> the intent of the Comprehensive Plan nor with the <br /> purpose and intent of the Highway 12 Planning Study. <br /> 2. The application appears to be compatible with all <br /> zoning amendments considered with the Planning Study. <br /> 3. The proposed use will have no negative impact on <br /> the health, safety and welfare of the public. <br /> B) Approval of conditional use permit and variances for <br /> accessory structure: <br /> 1. The detached structure is required by the P.C.A. <br /> for the storage of chemicals used in operation. <br /> 2. Structure will be located to rear of. main building <br /> and- screened by fenced area. <br /> 3. Location of structure will not present hazards for <br /> the general public nor occupants of main building but <br /> will provide even . greater safety measures for <br /> applicant's overall operation. <br /> 4. . Accessory structure will allow. applicant to clean up exterior <br /> storage area and comply with standards of Orono Ordinance 10.60, <br /> Subdivision 14 - Waste Materials. <br /> 5. The City Council finds that the conditions existing on this. <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting the variance <br /> would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring properties; <br /> would not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the appli- <br /> cant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> Page 2. of 5 <br />
