0.,�' <br /> O O <br /> ti <br /> CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> �kESII04 NO. 5250 <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#04-3063. <br /> 2. The property is located in the (I) Industrial District. <br /> 3. The Orono Planning Commission reviewed this application on October 20,2004 and <br /> on a vote of 7 to 0, recommended approval of extension of the timeframe for <br /> applicant to meet the conditions of approval of Resolutions No. 4845, 4993, 5059 <br /> and 5084 to December 31, 2005; and after further review of the application at a <br /> continued public hearing on November 3,2004 recommended approval on a vote of <br /> 6-0 for an amendment of the existing CUP to allow for revisions to the approved <br /> lighting plan for the easterly parking lot, finding that the proposed lighting plan to <br /> increase from four 25-foot poles each with double-1000 Watt downcast shoe-box <br /> style fixtures,to twelve such poles,will have no significant impacts on neighboring <br /> properties, and finding that such lighting is appropriate for the uses approved for the <br /> property. <br /> 4. The City Council finds that the proposed increase in lighting under the proposed plan <br /> will have minimal impacts on surrounding properties and is necessaiy to support the <br /> uses approved for this site while being designed in a manner that will minimize direct <br /> lighting spillover to surrounding properties. <br /> 5. The City Council finds that the basis for an extension of the effective period of <br /> Resolutions No. 4845, 4993 and 5059 as presented by the applicant is a unique <br /> circumstance which supports the granting of the extension. <br /> 6. The City Council has considered this application including the findings and <br /> recoinunendations of the Planning Commission,reports by staff and comments of the <br /> applicant and the effect of the proposed use on the health, safety, and welfare of the <br /> community. <br /> Page 2 of 6 <br />
