9. Fees and Expenses. The Developer agrees to pay all City fees required per the current <br /> City Fee Schedule and further agrees to completely reimburse the City for all the variable <br /> additional expenses it incurs in regard to the review and approval of the Improvements <br /> including, but not limited to, direct City payroll and overhead, costs, and fees paid to <br /> consultants and other professionals,which are not covered by City application fees. <br /> 10. Notice. Required notices to the Developer and the Owner shall be in writing, and shall <br /> be either hand delivered to the Developer, the Owner, their employees or agents, or <br /> mailed to the Developer and the Owner by registered mail at the following addresses: <br /> Notice to Developer Notice to Owner <br /> Amber Woods Office Centre, LLC Amber Woods Office Centre,LLC <br /> Philip Carlson Philip Carlson <br /> P.O. Box 184 <br /> Wayzata, MN 55391 Wayzata,MN 55391 <br /> Notices to the City shall be in writing and shall be either hand delivered to the City <br /> Administrator, or mailed to the City by registered mail in care of the City Administrator <br /> at the following address: Orono City Offices, 2750 Kelley Parkway, P.O. Box 66, <br /> Crystal Bay, Minnesota 55323, Telephone 952-249-4600. <br /> 11. Additional Conditions <br /> A. Turning radiuses of fire apparatus access roads on the Property shall be designed <br /> subject to approval of the City Engineer and Orono Fire Marshal. <br /> B. Fire lanes will be marked with the appropriate street signage and yellow curbing. <br /> Orono Fire Marshal will determine fire lanes upon review of the Plans and final <br /> access routes and at that point determine exact placement of signs and yellow <br /> curbing. <br /> C. The walk-out elevations of the buildings shall be as set out in Document C34 of the <br /> construction documents dated March 20, 2007 unless modified with the approval of <br /> the City Engineer. <br /> D. Storm sewer facilities which lie outside of public right-of-way shall be privately <br /> owned and maintained by the Developer until the end of the period of Developer <br /> control of the association at which time they will be maintained by the Amber Woods <br /> Office Center Association. <br /> E. All sanitary sewer and water connection lines within the Property shall be owned and <br /> maintained by the Developer until the end of the period of Developer control of the <br /> association at which time they will be maintained by the Amber Woods Office Center <br /> Association. <br /> Developer Initial <br /> ?/Z— <br /> City Clerk Initial <br /> Page 6 of 9 <br />
