Upon approval of this Resolution the City Council shall direct the Mayor and Clerk <br /> to execute other documents required by this PUD rezoning,including but not limited <br /> to the "Planned Unit Development No. 3 Agreement". . � <br /> 4. 1Vlinor changes in the location,placement and height of structures may be authorized <br /> by the Development Review Committee if required by engineering or other <br /> circumstances not foreseen at the time the final plan was approved and filed with the <br /> Zoning Administrator. <br /> 5. Changes in uses: Significant changes in the location, size, or height of the Medical <br /> Office structure, and any other changes to the approved final development plan <br /> deemed bythe Zoning Administrator to be significant maybe made only after a public <br /> hearing conducted by the Council.Any changes shall be recorded as amendments to <br /> the recorded copy of the final development plan. , <br /> � 6. If substantial development has not occurred within one year after approval of PUD . <br /> � No. 3 as set forth in the Planned Unit Development No. 3 Agreement, the City <br /> Council may declare the approvals granted within this resolution and within said � <br /> Agreement as null and void. . <br /> 7. It is specifically noted that further development of the Adjacent Parcel for a use <br /> allowed in the B-6 District is anticipated.Such further development shall be governed <br /> bythe Planned Unit Development process.Those portions of the Adj acent Parcel used <br /> to meet parking requirements for the Property shall not be used in calculations related <br /> to development of the Adjacent Parcel. However, calculations of lot area, park <br /> . dedication fees,storm water trunk fees,sewer and water connection fees,etc.for the <br /> Adjacent Parcel shall be calculated based on the entire area of the Adjacent Parcel. <br /> 8. The approvals granted in this Resolution shall not become effective until such time • <br /> that the Developer successfully completes purchase and provides suitable evidence <br /> of ownership of the Property and the Adjacent Parcel. <br /> 9. The approvals granted in this Resolution shall become effective only when <br /> all conditions of approval requiring actions by the Applicants have been satisfied. . <br /> `� . . <br /> Page 5 of 7 <br />
