The City Council finds that the conditions existing on this <br /> property are peculiar to it and do not apply generally to other <br /> property in this zoning district; that granting these variances <br /> would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring properties; <br /> would not merely serve as a convenience to the applicant, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the appli- <br /> cant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 7. The City Council finds that granting conditional use permits <br /> to allow the installation of a day care center/nursery school <br /> prior to the completion of the Highway 12 Planning Study will not <br /> be detrimental to the health, safety or general welfare of the <br /> public, would not adversely affect light, air nor pose a fire <br /> hazard or other danger to neighboring properties, nor will it <br /> depreciate surrounding property values and that the proposed <br /> level of use of the property will be in keeping with the intent <br /> and objectives of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City <br /> Council hereby grants a variance to Ordinance 13, Second Series and a <br /> conditional use permit per Section 10.28, Subdivision 3 (A) to permit <br /> the installation of a day care center/nursery school prior to the <br /> expiration of the Temporary Limited Development Ordinance and a <br /> variance to Section 10.55, Subdivision 8 and a conditional use permit <br /> per Section 10.03, Subdivision 20 to permit the construction of a <br /> private roadway within 15 feet of a designated wetland rather than the <br /> required 26 feet, subject to the following conditions: <br /> 1. Prior to the issuance of permits for building or land <br /> alterations on the above described property, the City must be in <br /> receipt of the following: <br /> A) Developer's Agreement with appropriate security to <br /> assure the following is completed as approved by the City: <br /> 1 ) Landscaping per Page 4 of final plans referred to <br /> as Final Landscaping Plans. <br /> Page 3 of 5 <br />
