The purpose of the wetland alteration is to convert a ditch to a pond that <br /> will serve as a storm water pond. <br /> b. The pond will treat the runoff upstream discharge area before it is <br /> discharged downstream, ultimately flowing through Peavey Lake into Lake <br /> Minnetonka. <br /> c. Created wetland and wetland buffers will mitigate the loss of 0.19 acre of <br /> wetland. <br /> d. To offset the mitigation area proposed to be abandoned an equivalent area <br /> of wetland and wetland buffer has been created. <br /> 3. The Planning Commission reviewed this application on February 16, 2010 and <br /> on a vote of 5 - 0 recommended approval of the conditional use permit. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, <br /> comments by the owners and the public, and the effect of the proposed <br /> conditional use on the health, safety and welfare of the community as well as <br /> the impact on properties in the vicinity. <br /> 5. The City Council finds that granting the conditional use permit is in accord <br /> with the objectives and purposes of the RR-1B zoning district in which the site <br /> is located and of the City's wetland protection regulations as well as with the <br /> comprehensive municipal plan. The City Council also finds the proposed <br /> wetland and land alteration would not be detrimental to the public health, <br /> safety or welfare, or materially injurious to properties or improvements in the <br /> vicinity. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a conditional <br /> use permit for wetland alteration and for land alteration to convert a ditch with wetland <br /> Page 2 of 4 <br />
