designate in writing at least thirty (30) days in advance of any rental payment date by notice <br />given in accordance with Paragraph 19 below. Lessor and Lessee agree that they shall <br />acknowledge in writing the Commencement Date of each Supplement. Lessor and Lessee <br />acknowledge that the initial rental payment for each Supplement may not actually be sent by <br />Lessee until ninety (90) days after Lessee's receipt of written acknowledgement confirming the <br />Commencement Date of each Supplement. Upon agreement of the Parties, Lessee may pay rent <br />by electronic funds transfer. Lessor hereby agrees to provide to Lessee the reasonable <br />documentation required for Lessee to pay all rent payments due to Lessor, including a <br />completed, most current version of Internal Revenue Service Form W-9. Annual Rental shall <br />accrue in accordance with this Agreement, but lessee may not deliver rental payments for up to <br />ninety (90) days after the requested documentation has been received by Lessee. <br />7. ELECTRICAL. Lessor shall, at all times during the Term of each Supplement, <br />provide electrical service and telephone service access within the Premises. As provided by <br />Minnesota Statutes Sections 237.162-.163, an annual fee for electricity used to operate the Small <br />Wireless Facility, if not purchased directly from a utility, shall be paid with the annual rent due <br />under each Supplement at the rate of. <br />A. $876.00 per radio node less than or equal to 100 max watts; <br />B. $2,184.00 per radio node over 100 max watts; <br />C. The actual costs of electricity, if the actual costs exceed the amount in item (A) or <br />(B); or <br />D. As agreed upon by Lessor and Lessee. <br />The amount of any such annual fee shall be set forth in each Supplement. <br />Lessee shall be permitted at any time during the Term of each Supplement, to install, <br />maintain, and/or provide access to and use of, as necessary (during any power interruption at the <br />Premises), a temporary power source and a temporary installation of any other services and <br />equipment required to keep Lessee's communications facility operational, along with all related <br />equipment and appurtenances within the Premises, or elsewhere on the Property in such locations <br />as reasonably approved by Lessor. Lessee shall have the right to install conduits connecting the <br />temporary power source, and the temporary installation of any other services and equipment <br />required to keep Lessee's communications facility operational, and related appurtenances to the <br />Premises. <br />Alternatively, Lessee may purchase electricity directly from a utility provider. <br />8. APPLICATION FEES AND ENGINEERING COSTS. The Parties acknowledge <br />and agree that, pursuant to the FCC Order and Minnesota Statutes, Sections 237.162-.163, Lessor <br />may charge a non-recurring application fee not to exceed $500 for an application to collocate on <br />existing structures for up to five facilities and $100 for each additional facility beyond five (the <br />"Application Fee"), which shall cover all of Lessor's non-recurring fees. The Application Fee <br />shall be paid with the submission of each Supplement. <br />9. USE. Lessee shall use the Premises for the purpose of constructing, maintaining, <br />repairing and operating Small Wireless Facilities and uses incidental thereto.
