The OWNER acknowledges that simultaneously with the execution of this Agreement that he has received all written notices required under M.S.A. 514.011 (Notice of intention to file Mechanic's Lien.) ATTENTION OWNERS (a) ANY PERSON OR COMPANY SUPPLYING LABOR OR MATERIALS FOR THIS IMPROVEMENT TO YOUR PROPERTY MAY FILE A LIEN AGAINST YOUR PROPERTY IF THAT PERSON OR COMPANY IS NOT PAID FOR THE CONTRIBUTIONS. (b) UNDER MINNESOTA LAW,YOU HAVE THE RIGHT TO PAY PERSONS WHO SUPPLIED LABOR OR MATERIALS FOR THIS IMPROVEMENT DIRECTLY AND DEDUCT THIS AMOUNT FROM OUR CONTRACT PRICE,OR WITHOLD THE AMOUNTS DUE THEM FROM US UNTIL 120 DAYS AFTER THE COMPLETION OF THE IMPROVEMENT UNLESS WE GIVE YOU A LIEN WAIVER SIGNED BY PERSONS WHO SUPPLIED ANY LABOR OR MATERIAL FOR THE IMPROVEMENT AND WHO GAVE YOU TIMELY NOTICE. In the event it becomes necessary for the CONTRACTOR to file a mechanic's Lien Statement because of non-payment by the OWNER of any sum required under this remodeling construction contract,then,and in that event,the OWNER shall pay in addition to all sums required thereunder,the cost of the preparation and filing of Mechanic's Lien Statement, including reasonable attorneys' fees in connection therewith,as well as all other fees and costs allowed by the statute. This shall be considered as the contractor's timely notice. Payment to be as follows: '/2 down r/2 upon completion 3% fee added for all credit card payments. l$PROPOSE hereby to furnish material and labor, complete with above specifications, for the sum of Price $ 34,262.00 plus any required permit fees, Down Payment $ 3,426.00 Past due accounts - add 1 '/2% of balance per month. Any alteration or deviation from above specifications involving extra costs will be executed only upon Subject to Office Approval written orders and will become an extra charge over and above the estimate. All agreements contingent upon strikes,accidents or delays beyond our control. Owner Note: This proposal may be to carry fire,tomado and other necessary insurance upon work above. A.C.T.is withdrawn by us if not accepted within 30 days. fully covered by Workers Compensation and General Liability Insurance.
