CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> 1litOAt\jpiloc, <br /> NO. 7058 <br /> G <br /> . Es HO <br /> depicted on the plans dated October 22, 2019 prepared by Civil Site Group, attached as Exhibit <br /> A, subject to the following conditions: <br /> 1. No structure may be closer than 75 feet to the lake on either side. <br /> 2. The Average Lake Shore Setback shall be 75 feet from the Ordinary High Water line on <br /> all sides. <br /> 3. The property line between lot 1 and the adjacent Ivy Place Plat lot 2 shall function as a side <br /> property line, requiring 15 feet setback(150%of 10 feet side yard setback for LR-1C). <br /> 4. Declaration and documentation of wetland buffer as required by MCWD. <br /> 5. All comments of the city engineer, outlined in a memo dated August 14, 2017 for the <br /> original Ivy Place Plat shall remain applicable. <br /> 6. Ivy Place and the portion of the drive within the easement at 3560 Ivy Place shall be <br /> inspected and its condition noted prior to construction. All damage shall be repaired to the <br /> satisfaction of the city prior to release of financial security. <br /> 7. The applicant had represented they have legal access. To the extent that the access rights <br /> are modified through court order or other means, the plat would be voided. <br /> 8. Council approval is based on the entire record, above Findings. <br /> 9. Any amendments to the plans which are not in conformity with City codes may require <br /> further Planning Commission and City Council review. <br /> 10. An easement providing access through lot 1, Block 1 Ivy Place second addition shall be <br /> granted to the benefit of the city and the owner of Lot 2, Block 1, Ivy Place. <br /> 10. Authorities granted by this resolution run with the Property not with the Applicants, but <br /> are permissive only and must be exercised by filing a final Plat application within one year <br /> of the date of Council approval, or the preliminary plat will expire on that date (December <br /> 9, 2020). <br /> 11. Violation of or non-compliance with any of the terms and conditions of this resolution may <br /> result in the termination of any authority granted herein. <br /> 3 <br />
