District <br /> Improving Quality of'late;; Quality of Life <br /> July 18, 2001 <br /> Gray Freshwater Center Greg Kellenberger <br /> Hwys.15&19,Navarre 4045 Watertown Road <br /> Orono, MN 55359 <br /> Mail: <br /> 2500 Shadywood Road Mr. Kellenberger: <br /> Excelsior,MN 55331-9578 <br /> Phone:(952)471•0590 After reviewing the application for the proposed construction project <br /> identified as MCWD Permit 01-270, and subsequent review of the <br /> Fax:(952)471-0682 conditions of the implied wetland adjacent to your property, it has been <br /> deemed that the said wetland will be classified as an"incidental wetland." <br /> The Minnesota Wetland Conservation Act states an exemption from the <br /> Email: law may occur if the land owner can prove that the wetland was "created <br /> admin@minnehahacreek.org solely by actions, the purpose of which was not to create the <br /> Web Site: wetland"(MN WCA II-B.5). After reviewing the circumstances <br /> www.minnehahacreek.org responsible for creating the said wetland, MCWD has come to the <br /> conclusion that the said wetland in question had indeed been the result of <br /> damage occurring to a number of drain tiles on both the land owner's site <br /> and an adjacent property. This has been documented through aerial <br /> photographs indicating that the wetland did not exist prior to 1997, and <br /> further confirmed by a site meeting on July 17, 2001 attended by the <br /> Board of Managers permit applicant, David Thill, Hennepin County Conservation District; <br /> Pamela G.Blixt Lyle Oman, City of Orono; and MCWD. <br /> James Calkins <br /> Lance Fisher MCWD has come to the conclusion that the wetland in question will thus <br /> be exempt from the Minnesota Wetland Conservation Act and <br /> Monica Gross subsequently from MCWD Rule D: Wetland Protection. It has been <br /> Scott Thomas determined that the project identified as MCWD Permit 01-270 will only <br /> Malcolm Reid require approval for Rule B: Erosion Control.
