The location of the well on the west side yard also forces septic further west <br /> on property in order to meet the required separation setback between well and <br /> septic system. <br /> D. Extensive yard to the south of the residence has been rendered useless for <br /> septic development because of the historic horse use of the property. <br /> E. Three trees will be removed as a result of these improvements. One tree will <br /> be saved and replanted on the property. <br /> F. A major stand of trees and plantings along the east lot line will minimize any <br /> visual impact of the expansions within the substandard side and street yard <br /> area. <br /> 4. The City Council finds that the conditions existing on this property are peculiar to <br /> it and do not apply generally to other property in this zoning district; that granting <br /> the variances would not adversely affect traffic conditions, light, air nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicant, but is necessary to alleviate a demonstrable hardship <br /> or difficulty; is necessary to preserve a substantial property right of the applicant; and <br /> would be in keeping with the spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments by <br /> the applicant and the effect of the proposed variance on the health, safety and welfare <br /> of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings,the Orono City Council hereby grants <br /> variances to Municipal Zoning Code Section 10.27, Subdivision 5 (A) to permit the construction of <br /> an addition located to the west and south of residence, and a 24' x 24' garage addition to the east <br /> requiring a 48% street setback and 48% side setback variance, subject to the following conditions: <br /> Page 2 of 5 <br />
