LA19-000082 <br /> WHEREAS, on September 17, 2019, John Buboltz and Christine Buboltz(hereinafter <br /> the "Applicants"), applied for variances from the City Code for the property addressed 1973 <br /> Fagerness Point Road and legally described as: <br /> Lot 7, Fagerness, Hennepin County, Minnesota (hereinafter the "Property"); <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-350 to allow rebuild of an attached garage <br /> addition with a 5.2 foot setback from the side where a 7.5 foot setback is required and a 5.7 foot <br /> setback from Eagerness Point Road where a 30 foot setback is required and a 1.7 foot setback <br /> currently exists; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of additions to <br /> the home, a reconfigured, reconstructed attached garage, and lakeside balcony within the <br /> average lakeshore setback and within the 75-foot setback from the OHWL; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1680 to allow an additional 607 square feet <br /> of hardcover within the 75-foot setback where 1,197 square feet currently exists, and 1,804 <br /> square feet is proposed in conjunction with the home additions; and <br /> WHEREAS, on October 21, 2019, after published and mailed notice in accordance <br /> with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br /> which time all persons desiring to be heard concerning this application were given the opportunity <br /> to speak thereon; and <br /> WHEREAS, on October 21, 2019, the Planning Commission recommended <br /> approval of the variances; and <br /> WHEREAS, on November 12, 2019, the City Council reviewed the application and <br /> the recommendations of the Planning Commission and City staff; and <br /> I <br />
