*A/4CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. 704 3 <br /> kESHOv-� <br /> A RESOLUTION VACATING <br /> A PARTIAL RELEASE AND VACATION AND GRANT OF <br /> PERMANENT EASEMENT FOR PUBLIC TRAIL <br /> WITHIN THE PLAT OF ORONO PRESERVE, <br /> HENNEPIN COUNTY, MINNESOTA <br /> FILE NO. LA19-000079 <br /> WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS, on September 16, 2019, Stephanie Griffin o/b/o Weekley <br /> Homes LLC,(hereinafter the"Applicant"),applied for vacation of a portion of the public <br /> trail easement within Lot 8, Block 1, Orono Preserve, legally described and depicted in <br /> Exhibit A <br /> WHEREAS, on October 21, 2019, after published and mailed notice in <br /> accordance with Minnesota Statutes and the City Code,the Planning Commission held <br /> a public hearing, at which time all persons desiring to be heard concerning this <br /> application were given the opportunity to speak thereon; and <br /> WHEREAS, on October 21, 2019, the Planning Commission <br /> unanimously for a motion to recommend approval of the requested vacation; and <br /> WHEREAS, on November 12, the City Council reviewed the <br /> application and the recommendations of the Planning Commission and City staff; and <br /> WHEREAS, the Orono Council finds the vacation as proposed is in <br /> keeping with the public interest and in consideration of the following findings: <br /> 1. There are no drainage or utility improvements within the Easement. <br /> 2. The City Council finds that the existing Easement has no apparent <br /> present or future benefit to the public. <br /> 3. A new easement must be established over the existing trail to maintain <br /> public access depicted in Exhibit A. <br /> Page 1 of 2 <br />
