<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. ________________________ <br /> <br /> <br />5 <br /> <br />CONCLUSIONS, ORDER AND CONDITIONS: <br /> <br /> Based upon one or more of the above findings, the Orono City Council hereby grants a <br />variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of an accessory <br />building, a barn not to exceed 1,800 square foot in footprint, subject to the following conditions: <br /> <br />1. Council approval is based on the entire record, above Findings. <br /> <br />2. The approved project shall conform to the survey dated 09/12/19 by W. Brown Land <br />Surveying and building plans submitted by the Applicants and annotated by City staff, <br />attached to this Resolution as Exhibits A & B. <br /> <br />3. Any amendments to the plans which are not in conformity with City codes may require <br />further Planning Commission and City Council review. <br /> <br />4. By signing this Resolution, the Applicants agree to the filing of a covenant in the title of <br />the Property. The barn is considered an oversize accessory building (an “OAB”), and <br />shall be allowed only when the Applicants agree and covenant in writing with the city <br />as follows: <br />a. No future subdivision will be approved that places the OAB within a lot that has <br />no principal building, except that the city in its subdivision approval may grant a <br />finite time period in which the OAB may remain without a principal building, in <br />order that a principal building may be constructed. At the end of this time <br />period, the OAB must be removed if no principal building has been constructed. <br />b. If the Property is subdivided, the OAB and principal building will be located <br />together within a lot that meets the minimum lot area requirement for the given <br />size of the OAB. <br />c. In subdivision approval, the setback required for the OAB shall remain. <br />d. Such covenant shall be binding on current and future property owners and shall <br />be filed in the chain of title of the Property. <br />5. Authorities granted by this resolution run with the Property not with the Applicants, but are <br />permissive only and must be exercised by obtaining a building permit for the barn and <br />commencing construction of said project. A framing inspection must be completed within <br />one year of the date of Council approval, or the variance will expire on that date (November <br />12, 2020). <br /> <br />6. Violation of or non-compliance with any of the terms and conditions of this resolution may <br />result in the termination of any authority granted herein. <br /> <br />
