The purpose of this item is for City Council to accept the sanitary sewer, water and <br />stormwater utilities as well as the public streets within the Orono Preserve development. <br /> <br />2. Background. The Orono Preserve development was approved subject to the terms of the <br />Development Contract and Residential Planned Unit Development Agreement, Orono Preserve, <br />PUD#11, 16-3807 / 16-3842, executed by the developer and the City September 16th, 2016. Per the <br />contract the water, sanitary sewer and storm water utilities as well as the roadway are to be a public <br />facilities owned, operated and maintained by the City of Orono. The sidewalks are a public <br />improvement to be maintain by the homeowners with the exception of the connection between the cul- <br />de-sac and Wayzata Blvd which will be maintained by the City. In subsection 23 the agreement states <br />that the final security will be returned to the developer once the public improvements are accepted by the <br />City Council. <br /> <br />3. Public Improvements. The development infrastructure that is public include the water system, <br />sanitary sewer system, the stormwater system, the roadway and sidewalks. <br /> <br />4. Staff Recommendation. I recommended formal acceptance of the water system, sanitary sewer <br />system, the stormwater system, the roadway. Numerous sidewalk panels are damaged and not ready for <br />acceptance at this time. <br /> <br />COUNCIL ACTION REQUESTED: <br />Motion to adopt a resolution accepting the water system, sanitary sewer system, the stormwater system, <br />the roadway improvements within Orono Preserve as public facilities. <br /> <br /> <br />Exhibits <br />A.
