The owner’s comment that access through <br />the property will continue offers no protection against changing wishes of the property owner, or <br />a future property owner. Staff does not support this part of the proposal. The amount of private <br />land necessary for the cul de sac is approximately 2600 sq ft, and the amount of land to be <br />vacated is approximately 28,750 sq ft, exclusive of trail easement. <br /> <br />The private utilities have highlighted the need for an easement to protect their infrastructure. <br /> <br />5. Planning Commission Vote and Comment. On October 21st, the Planning Commission <br />reviewed the application. Planning Commission draft minutes are attached as Exhibit D. The <br />Planning Commission, in a 6-1 vote (Erickson) recommended denial of the application because <br />the solution to the issues (cul de sac, trail easement, etc.) were not shown on a plan. Erickson <br />voted no on the motion to deny because he preferred to recommend approval subject to those <br />conditions. <br /> <br />6. Public Comment. A number of written comments for and against the vacation have been <br />received, and are attached as Exhibit E. <br /> <br />7. Staff Recommendation. Staff recommends that public interest can be maintained with the <br />following: <br /> <br />a. Provision of land for construction of a cul de sac as shown on the attached Exhibit C. <br />b. Provision of a trail easement more directly connecting Smith Avenue and the Luce Line <br />through the property. <br />c. Provision of an easement to protect existing utilities. <br /> <br />Regardless of the response on the vacation question, Staff recommends establishment of <br />a formal trail connection between Smith and the Luce Line, removing the trail connection <br />that encroaches on private property. <br /> <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should direct staff to prepare a resolution for approval or denial. <br /> <br />Exhibits <br />A.
