To consider an ordinance removing gardens as a principal use while protecting the <br />existing community garden. <br /> <br />2. Background. At their workshop on August 12, the Council directed staff to prepare an ordinance <br />related to gardens as a principal use. <br /> <br />Gardens were added as a permitted use in 2011, as the Council considered initiating a community <br />garden on city property. Gardens were not defined, and recently have been used to circumvent <br />dock regulations in the city. <br /> <br />Existing gardens as a principal use will be permitted to continue as a non-conforming use, <br />provided they are not abandoned for a period longer than12 months. <br /> <br />3. Planning Commission Vote and Comment. On September 16th, the Planning Commission held <br />a public hearing. Following the public hearing, the Planning Commission voted 6-0 on a motion <br />to approve the ordinance. The members of the Commission were in agreement that gardens <br />should not be the principal use of a lot. <br /> <br />4. Public Comment. To date, no comments have been received. <br /> <br />5. Staff Recommendation. Staff recommends the Council adopt the ordinance as drafted. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should review the ordinance and adopt or amend. <br /> <br />Exhibits <br />A.
