Butterfield Greenhouses <br /> 3925 Watertown Road <br /> Maple Plain, Minnesota 55359 <br /> Dear Mr. Butterfield: <br /> We have reviewed the information provided us about your project to <br /> excavate approximately 2b0 cubic yards of peat from an unnamed wetland. The <br /> project site is in the sW 1/4 SW 1/4 Sec. 32, T. 118 N., R. 23 W. , Hennepin <br /> County, Minnesota. <br /> Because this work is part of a continuing or seasonal excavation, a <br /> Department of the Army permit is not required to do this work, provided that <br /> the work is completed by September 24, 1994. You should submit a permit <br /> application if you wish to continue excavating in this area after that date. <br /> Because it appears that the excavation site is historically adjacent to Lake <br /> Minnetonka, you would need to gptain an individual Department of the Army <br /> permit to continue working at this site under the current rules. (An <br /> application is enclosed. Note that many nearby sites, that are part of <br /> smaller drainage systems, are covered by nationwide general permits that could <br /> expedite our approval of such a project. In addition, we are working on <br /> regional general permits that may simplify our review of such projects, even <br /> at your current site. We will advise you of any changes in the need for a <br /> permit if you submit an application or Contact our office about future work. ) <br /> This letter is valid only for the project referenced above. If any <br /> change in design, location, or purpose is contemplated, contact this office to <br /> avoid doing work that may be in violation of Federal law.
