<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. ________________________ <br /> <br /> <br />2 <br /> <br />Trustees' Deed dated September 26, 1938, between Charles Koon Velie, et al as Trustees <br />under the Last Will and Testament of Charles D. Velie, deceased, and said Carpenters, filed for <br />record in the Office of the Register of Deeds of Hennepin County, Minnesota, on November 10, <br />1938, in Book 1445 of Deeds, Page 293, and <br />Line X and Line Y are a portion of the Westerly boundary of the property conveyed by said <br />Trustees' Deed of September 26, 1938 to said Carpenters, and are now a part of the West line <br />of the plat of LITTLE ORCHARD, Hennepin County, Minnesota (hereinafter the “Property”); <br /> WHEREAS, the Applicants have made application to the City of Orono for an <br />interim use permit pursuant to Orono Municipal Zoning Code Section 78-1726 to allow the <br />export of approximately 3,200 cubic yards of excess fill material from the Property in conjunction <br />with construction of a new residence; and <br /> <br /> WHEREAS, on August 19, 2019, after published and mailed notice in accordance <br />with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at <br />which time all persons desiring to be heard concerning this application were given the <br />opportunity to speak thereon; and <br /> <br /> WHEREAS, on August 19, 2019, the Planning Commission recommended <br />approval of the interim use permit; and <br /> <br /> WHEREAS, on September 9, 2019, the City Council reviewed the application <br />and the recommendations of the Planning Commission and City staff; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, <br />Minnesota hereby approves the requested interim use permit as described above based on one <br />or more of the following findings of fact concerning the Property: <br /> <br />FINDINGS OF FACT: <br /> <br />1. This application was reviewed as Zoning File #LA19-000054. The analysis contained <br />within staff memos and the exhibits attached to the aforesaid memos, all minutes from <br />the above mentioned meetings, and any and all other materials distributed at these <br />meetings are hereby incorporated by reference. <br /> <br />2. The Property is located in the LR-1A Single Family Lakeshore Residential Zoning <br />District. <br /> <br />3. The Property contains 2.46 acres in area and has a defined lot width of 210 feet. <br />
