(reserved for recording information) <br /> FIRST AMENDMENT TO <br /> GRANT OF PERMANENT EASEMENT <br /> FOR PUBLIC TRAIL PURPOSES <br /> THIS FIRST AMENDMENT TO GRANT OF PERMANENT EASEMENT FOR <br /> PUBLIC TRAIL PURPOSES (the "Amendment") is entered into by and between WEEKELY <br /> HOMES, LLC, a Delaware limited liability company, hereinafter referred to as "Grantor," as <br /> successor in interest to OP5 Orono,LLC,a Minnesota limited liability company("Original Grantor"), <br /> and the CITY OF ORONO, a municipal corporation organized under the laws of the State of <br /> Minnesota,hereinafter referred to as the"City", as of the day of ,2019. <br /> RECITALS: <br /> WHEREAS, Original Grantor granted the City a permanent easement for public trail <br /> purposes pursuant to that certain Grant of Permanent Easement for Public Trail Purposes dated the <br /> September 16, 2016, and recorded on October 18, 2016 in the Office of the County Recorder in <br /> and for Hennepin County, Minnesota as Document No. A10369460 ("Grant of Easement"); <br /> WHEREAS, Grantor and the City desire to amend the Grant of Easement pursuant to and <br /> in accordance with the terms of this Amendment. <br /> NOW,THEREFORE,it is hereby agreed by and between the City and Grantor as follows: <br /> 1. RECITALS. The foregoing recitals are true and correct and incorporated herein by <br /> this reference. <br /> 2. EASEMENT PREMISES. Exhibit "A" to the Grant of Easement, containing the <br /> legal description of the Easement Premises,shall be and is hereby amended and replaced by Exhibit <br /> "A" attached hereto. All references to Exhibit"A" in the Grant of Easement shall mean and refer <br /> to Exhibit"A" attached hereto.
