O ` V <br /> 0 <br /> CITY of ORONO <br /> ^ _ <br /> 54)) <br /> $, ��� �Gti RESOLUTION OF THEA TY COUNCIL <br /> `�kESxog' NO. 3 6 5 <br /> A RESOLUTION VACATING <br /> A CONSERVATION AND FLOWAGE EASEMENT <br /> WITHIN LOT 2, BLOCK 1, KLITZKE ADDITION <br /> IN THE CITY OF ORONO, HENNEPIN COUNTY, MINNESOTA <br /> FILE NO. 2082 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS, on October 6, 1995, Richard Miller Stark (hereinafter the applicant) <br /> filed a petition with the City of Orono requesting the vacation of a conservation and flowage <br /> easement orginally dedicated in the plat of Stielow Addition, Hennepin County, Minnesota and <br /> legally described as follows: <br /> Refer to Exhibit A attached; and <br /> WHEREAS, after due published and posted notice, a public hearing was held <br /> before the City's Planning Commission on November be heard; and 95 regarding said vacation and all <br /> interested persons were given an opportunity <br /> WHEREAS, after due standing and consideration, the Planning Commission <br /> recommended unanimous approval of the proposed vacation; and <br /> WHEREAS, the City Council of the City of Orono finds that said vacation as <br /> proposed is in keeping with the public interest and in consideration of the following findings: <br /> 1. Applicant's consultant. Jay Riggs, an Environmental Specialist of Westwood Professional <br /> Services. Inc., has submitted a wetland delineation report dated July 31, 1995 locating <br /> a wetland area within lakeshore yard of Lot 2, Block 1, Klitzke Addition. <br /> 2. The City Engineer Shawn Gustafson in his report dated August 8, 1995 reconfirmed the <br /> findings of that wetland delineation report. The findings of the report confirm that the <br /> wetland area protected under the original conservation easement dedicated in 1978 with <br /> the Stielow Addition was incorrectly designated. <br /> Page 1 of 3 <br />
