Minnesota Pollution Control Agency <br /> November 29, 2000 <br /> Mr. James Render <br /> Render Residence <br /> 5120 Edina Industrial Boulevard <br /> Edina, MN 55439 <br /> RE: Petroleum Storage Tank Release Investigation and Corrective Action <br /> Site: Render Residence, 1365 Tokawa Road, Orono <br /> • Site ID#: LEAK00011855 <br /> Dear Mr. Render: <br /> On September 25, 1998, the Minnesota Pollution Control Agency(MPCA) staff was notified that a <br /> release of petroleum occurred from storage tank facilities that you own and/or operate at the site <br /> referenced above. On October 10, 1998,November 8, 1999, and more recently, on August 17,2000,the <br /> MPCA staff requested that you take the steps necessary to investigate the petroleum tank release at your <br /> site.. . _ _ <br /> A recent review of our files indicates that we have not heard from you whether you intend to investigate <br /> and if necessary, clean up the petroleum contamination at this site. We again ask that you respond in <br /> writing to this letter and describe the status of your investigation and/or cleanup, or explain why no <br /> action has been taken. You must respond within 10 days of receipt of this letter. Failure to do so <br /> may result in reduced reimbursement from the Petrofund and/or enforcement action taken against <br /> you by the MPCA. <br /> Please respond in writing to indicate your intentions for further action at this site. If your <br /> response is not received by the MPCA within 10 days after receipt of this letter,MPCA <br /> staff will assume you do not intend to comply with this request. In this event, the MPCA <br /> Commissioner may order you to take corrective action at the site. If you do not comply with <br /> the Commissioner's order, it may be-enforced in court or alternatively, the MPCA could spend its <br /> own money cleaning up the release and then seek to recover its costs from you through legal <br /> action. Other possible courses of action against responsible parties who refuse to cooperate with <br /> this agency include, but are not-limited to,a reduction to future Petroleum Tank Release <br /> Compensation Account reimbursements to which you might otherwise be entitled, and <br /> substantial civil penalties for failure to comply. <br /> 520 Lafayette Rd.
