AGENDA ITEM <br />Item No.: 10 <br />Date: August 12, 2019 <br />Item Description: LA19-000033 — Chuck Alcon o/b/o Eric and Andrea Larson, 690 <br />Brown Road, Final Plat and Development Agreement Approval <br />Presenter: Jeremy Barnhart, Community Agenda Consent Agenda <br />Development Director Section: <br />1. Purpose. This item is to consider the Final Plat of Willow Bay Sanctuary, a 7 lot subdivision of 690 <br />Brown Road. <br />2. 15.99 Deadline. Application was received on May 15, 2019. The application was considered <br />complete on August 6t'', 2019. Action must be taken by October 5, 2019. <br />3. Background/ Summary. The City Council adopted resolution 6989 on May 13, 2019, approving the <br />preliminary plat for Willow Bay Sanctuary, a 7 lot single family residential subdivision. <br />The proposed final plat is consistent with the approved Preliminary Plat. All lots are consistent with the <br />Council direction in terms of lot width and area. The proposed use of the property, single family <br />residential at density of .5 units per acre is consistent with the Comprehensive Plan. The newly <br />developed properties will be served by water and sanitary sewer. <br />A Development Agreement has been prepared by the City Attorney, and has been signed by the applicant, <br />in anticipation of Council Approval. All costs associated with the development, including street/ utility <br />construction, storm water management, erosion control, etc., are the responsibility of the developer. <br />The Development Agreement includes the following provisions: <br />23 D. The existing lot, currently served by an onsite septic system, will be required to connect to <br />the municipal system the earlier of 1 year from the date the city accepts the system, or if the existing <br />home is demolished, the replacement home is built. <br />29E. One building permit may be issued on either lot 1 or Lot 7, Block 1, prior to the first lift of <br />asphalt. A Certificate of Occupancy may not be issued until the street has been paved, the utilities <br />accepted, and all drives off of Brown Rd are removed. <br />4. Staff Recommendation. Staff recommends approval of the Final Plat and authorization of the <br />Developers Agreement as proposed. <br />COUNCIL ACTION REQUESTED <br />Staff Recommendation: Motion to amend or adopt the attached resolution.
