AGENDA ITEM <br />Item No.: 17 <br />Date: August 12, 2019 <br />Item Description: LAI 9-000048 — Premium Construction LLC, 2967 Casco Point <br />Road, Variance — Resolution <br />Presenter: Laura Oakden Agenda Planning Department <br />Planner Section: Report <br />1. Purpose. The applicant is requesting average lakeshore setback, hardcover, lot area and lot width <br />variances. <br />2. Background. The applicant is proposing to remove the existing home and detached garage and <br />build a new home with an attached garage. The average lakeshore setback (ALS) is unique for this <br />property due to the neighboring lot to the north. That lot is flag shaped with the buildable portion set <br />much further back. Due to this configuration, the subject lot is not buildable without an ALS variance. <br />The current home is nonconforming due to this extreme setback and hardcover. The applicants are <br />proposing to build the new home with more massing forward of the average lakeshore setback compared <br />to what is there today. The proposal also requires lot area, lot width and hardcover variances. The <br />hardcover will decrease from the current level (30.5% to 29.5%) with the proposed plan but will remain <br />over the 25% maximum. <br />3. 15.99 Deadline. The application was deemed complete on July 1, 2019. The 60 -day review period <br />ends on August 30, 2019. <br />4. Planning Commission Vote and Comment. The Planning Commission reviewed and discussed the <br />request. The Commission voted (5-1, Ressler) to recommend approval of the requested variances. <br />5. Public Comment. Neighbor submitted acknowledgement signatures. The applicant referenced <br />support from the adjacent letter. No written confirmation of this support has been received. <br />6. Staff Recommendation Staff recommends approval with engineer's comments for the lot area, lot <br />width and hardcover variances. Staff recommends approval of the requested average lakeshore setback. <br />COUNCIL ACTION REQUESTED <br />Council should consider a motion to adopt or amend the approval resolution. <br />Exhibits <br />A.
