AGENDA ITEM <br />Item No.: 13 <br />Date: August 12, 2019 <br />Item Description: LAI 9-000051 — Dale Gustafson o/b/o John & Trudy Wilgers, <br />1905 Concordia St, Variance — Resolution <br />Presenter: Melanie Curtis Agenda Consent Agenda <br />Planner Section: <br />1. Purpose. This application is regarding variance approvals relating to repair of a <br />lakeshore slope failure. <br />2. MN§15.99 Application Deadline. The application was received on June 19, 2019 and <br />considered to be complete on July 3rd. Therefore the 60 -Day review period expires on <br />September 1, 2019. <br />3. Background/ Summary. While the foundation work for the new home was underway, <br />there were several consecutive rain events resulting in failure of the lower portion of the <br />lake slope on the property. The applicant is proposing to install a subterranean timber <br />wall grid system in the area of the recent slope failure. The grid layout will create <br />"boxes" to be filled with soil to recreate the slope. Deep rooted plants are proposed to be <br />installed on the slope. Because the walls are not permitted within the lake yard, a 75 -foot <br />lake setback variance is required. This is the second slope failure in the last 7 years. <br />4. Planning Commission Vote and Comment. On July 15th the Planning Commission held <br />a public hearing. Following the public hearing the Planning Commission voted 6 to 0 in <br />favor of a motion to approve the requested setback variance for the walls. <br />5. Public Comment. No written comments from the neighbors were received; one <br />neighbor spoke at the public hearing. Please refer to the draft minutes (Exhibit C) for <br />more detail. <br />6. Staff Recommendation. The City's engineer provided the following comments. Staff <br />recommends approval conditioned upon the applicant providing the requested <br />information. These conditions have been included in the draft approval resolution. <br />a. Wall and site plans specific to this site should be submitted for review and <br />approval. The plans should include existing and proposed contours, location of <br />subterranean wall (including draintile with pipe material, diameter, and invert <br />elevations indicated), erosion control, and proposed restoration/landscaping. <br />b. It appears that the slope repair needs to extend into the adjacent property to the <br />north. The design should include all areas needing stabilization, and a temporary <br />easement/permanent agreement may be necessary with the adjacent property <br />owner. <br />COUNCIL ACTION REQUESTED <br />Motion to adopt or amend the approval resolution. <br />Prepared By: V11GG <br />Reviewed By: J.
