CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />1. This application was reviewed as Zoning File #LA19-000028. The analysis contained <br />within staff memos and the exhibits attached to the aforesaid memos, all minutes from the <br />above mentioned meetings, and any and all other materials distributed at these meetings <br />are hereby incorporated by reference. <br />2. The Property is located in the LR -1C One Family Lakeshore Residential Zoning District. <br />3. The Property contains 0.18 acres in area and has a defined lot width of approximately 198 <br />feet at the ordinary high water level. <br />4. The Property is platted as an outlot, and therefore is not buildable. <br />5. Applicant has applied for the following variance[s]: <br />a. Back lot standards <br />b. Double frontage lots, access to lots, and front/ back lot divisions. <br />6. In considering this application for variance, the Council has considered the advice and <br />recommendation of the Planning Commission and the effect of the proposed variance <br />upon the health, safety and welfare of the community, existing and anticipated traffic <br />conditions, light and air, danger of fire, risk to the public safety, and the effect on values <br />of property in the surrounding area. <br />ANALYSIS: <br />The variance is in harmony with the general intent and purpose of the Ordinance. The intent of <br />the ordinance is the provision of a separate lot protecting access to a back lot while not <br />introducing additional density. The access can be provided via an easement, and the nature of <br />these lots do not lend themselves to further subdivision, i.e. density. <br />The variance is consistent with the comprehensive plan. The use of the property remains <br />residential, consistent with the comprehensive plan. <br />The applicant establishes that there are practical difficulties. <br />The property owner proposes to use the property in a reasonable manner not permitted <br />by the official controls; The use of the property remains the same. <br />There are circumstances unique to the property not created by the landowner; The <br />condition of the property prior to development, configured as three separate lots, was <br />not created by the developer. Further, the property is a peninsula and at the end of a <br />dead end street. <br />The variance will not alter the essential character of the locality. The variance, allowing <br />access to the back lot via an easement versus an outlot will not be discernable to the <br />character of the locality. <br />
