No variance shall be granted or changed beyond the use <br />permitted in this chapter in the district where such land is located. <br />Septic System Status <br />Staff has completed a preliminary review of the project for compatibility with the septic system, <br />and has determined that the project is not likely to impact the existing or future septic sites. <br />Practical Difficulties Statement <br />Applicant has provided supporting documentation regarding the applicable Practical Difficulties <br />attached as Exhibit B, and should be asked for additional testimony regarding the application. <br />Practical Difficulties Analysis <br />Staff finds the submitted application does not meet the practical difficulties standards. The <br />applicant has indicated they can meet the City Code by building a separate accessory structure. <br />There are not any unique circumstances with the land or the use to support a variance to allow <br />an accessory building larger than the code would permit. The applicant has not demonstrated <br />that the property is unique to support the variance, and the use of the property has been achieved <br />via the construction of the home and the 1,152sq foot accessory structure. <br />Public Comments <br />To date, no public comments have been received. The applicant submitted neighboring <br />signatures. <br />Issues for Consideration <br />1. Does the Planning Commission find that the practical difficulties are met for this <br />request? <br />2. Does the Planning Commission find there are unique circumstances with the <br />property, that don't also pertain to other properties? <br />3. Economic considerations alone do not constitute practical difficulties. Does the Planning <br />Commission conclude any other findings where the applicant must receive this <br />variance and cannot meet the city code in any way? <br />4.
